Terms of Service

These terms govern your use of bluecollarcompanion.co, demo.bluecollarcompanion.co, and edits.bluecollarcompanion.co (the “Sites”), operated by Blue Collar Companion, LLC, a Delaware limited liability company (“BCC,” “we,” “us”). By using the Sites you agree to these terms. If you don't agree, don't use the Sites.

The short version: the Sites are a storefront. If you hire us, the signed service agreement or statement of work we both sign is the real contract — where it conflicts with these terms, it wins.

1. Who the Sites are for

The Sites are for businesses. By submitting a form or opening a portal account you represent that you're at least 18 and authorized to act for the business you name.

2. Our services

We design and build websites, AI assistants, and business automations for trades businesses. What we'll actually deliver for you, and what it costs, is defined in a signed agreement — nothing on the Sites is a binding offer, quote, or guarantee.

3. Demo previews

We build no-obligation demo website previews for businesses, using their publicly available information. Demo previews are governed by the Demo Site Terms, which are part of these terms. If a demo preview is yours and you want it changed or gone, one email does it: hello@bluecollarcompanion.co.

4. Intellectual property

The Sites, our demo templates, our tooling, our frameworks, and our know-how are ours (or our licensors'). Hiring us doesn't transfer them; a signed agreement will spell out exactly what you own when the work is paid for. Business names, logos, and trademarks appearing in demo previews belong to their respective owners.

Materials you give us. If you supply logos, photos, text, or other content, you promise you have the right to let us use them, and you give us permission to use them to perform the services (and, unless you tell us otherwise, to show the finished work in our portfolio). You're responsible for claims arising from materials you supply or content you direct us to publish.

5. AI-assisted work and AI assistants

Some of our work product is produced with AI assistance, and some features on the Sites (like chat assistants, which are always labeled) are AI-powered. Two honest caveats:

Nothing on the Sites or from our AI assistants is legal, financial, or professional advice.

6. Acceptable use

Don't misuse the Sites: no unlawful use, no trying to break in, no scraping the Sites at abusive volume, no reselling or misrepresenting demo previews, no interfering with other users.

7. Portal accounts

Keep your login credentials to yourself. You're responsible for activity under your account; tell us immediately at hello@bluecollarcompanion.co if you think it's been compromised. We may suspend an account we reasonably believe is compromised or abusive.

8. Third-party services

The Sites and our deliverables rely on third-party services (hosting, AI model providers, email, fonts, stock media). We're not responsible for their outages or changes to their terms, and some features may require you to accept a third party's terms directly.

9. Disclaimers

THE SITES AND ALL CONTENT ON THEM ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITES WILL BE UNINTERRUPTED OR ERROR-FREE. WE DO NOT GUARANTEE ANY BUSINESS RESULT — INCLUDING SEARCH RANKINGS, LEAD VOLUME, OR REVENUE — FROM USE OF THE SITES OR FROM ANY EXAMPLE OR STATISTIC SHOWN ON THEM.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BCC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, ARISING FROM USE OF THE SITES. OUR TOTAL LIABILITY ARISING FROM THE SITES IS CAPPED AT THE GREATER OF (A) WHAT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AND (B) ONE HUNDRED U.S. DOLLARS ($100). This cap doesn't apply to our gross negligence or willful misconduct, or anywhere the law doesn't allow it. Services you've hired us for are governed by your signed agreement's liability terms, not this section.

11. Indemnification

You'll defend and hold us harmless from third-party claims arising from materials you supplied, content you directed, or your breach of these terms.

12. Termination

We may suspend or end access to the Sites (including portal accounts) for breach of these terms. Sections that by their nature should survive (4, 5, 9–14) survive.

13. Governing law and disputes

These terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Disputes arising from the Sites will be resolved exclusively in the state or federal courts located in Delaware, and both sides consent to that venue — except either side may use small-claims court where eligible, and we may seek injunctive relief for IP misuse anywhere it's needed.

14. Changes to these terms

We may update these terms by posting a new dated version here. Material changes get a prominent notice on this page for 30 days. Continued use of the Sites after a change means you accept it. Each version is dated so you always know which one you're reading.

15. The boring-but-important bits

If part of these terms is unenforceable, the rest stands. Our not enforcing something isn't a waiver. You can't assign these terms without our consent; we may assign them as part of a business transfer. These terms plus the Privacy Policy and Demo Site Terms are the entire agreement about using the Sites — signed service agreements govern services.
